Terms of Service

Version 2026-07-22 · Effective July 22, 2026

ACar's role: ACar Technologies, Inc. operates the platform. Certain dealer, title, registration, tax, temporary-registration, and related motor-vehicle services are performed by or through ACar NJ LLC, a licensed New Jersey used motor vehicle dealer. ACar's exact role in any vehicle transaction depends on the signed transaction documents for that vehicle.

1. Agreement and Incorporated Terms

These Terms are a binding agreement between you and ACar Technologies, Inc. for your use of ACar websites, apps, marketplace tools, checkout flows, messaging, scheduling, document signing, payment, title, registration, and related services.

These Terms incorporate the Privacy Policy, Cookie Policy, Financial Privacy Notice, SMS and Messaging Terms, Acceptable Use Policy, Disclaimers, Vehicle Selling Terms, Reservation Terms, Seller Payout Terms, Private Sale Service Agreement, Appointment and Test Drive Terms, Biometric Privacy Notice and Consent, E-Sign Consent, and any signed transaction document you accept in a specific deal.

If documents conflict, the following order controls unless applicable law requires otherwise:

  1. Non-waivable federal or New Jersey law.
  2. Vehicle-specific signed transaction documents for the applicable transaction.
  3. Service-specific terms shown in the applicable flow.
  4. These Terms.
  5. Incorporated policies, with the Privacy Policy controlling personal-information practices.

2. ACar Entities and Transaction Roles

ACar Technologies, Inc. operates the ACar vehicle marketplace and related platform services. ACar NJ LLC may perform licensed New Jersey used motor vehicle dealer services where the applicable transaction documents identify ACar NJ LLC as the dealer, seller, buyer, attorney-in-fact, title/registration processor, or temporary-registration issuer. ACar NJ LLC's licensed name, licensed address, and New Jersey dealer license information are stated in the applicable transaction documents and on ACar's dealer disclosure page once published.

ACar's role depends on the service and transaction documents:

3. Eligibility and Accounts

You must be at least 18 years old and legally able to enter binding contracts. You must provide accurate information, keep it current, protect your login credentials, and notify us promptly of unauthorized account use.

We may require identity verification, sanctions/fraud screening, insurance verification, title verification, lien payoff information, payment verification, and other documents before allowing a listing, test drive, purchase, payout, temporary registration, or MVC submission.

You are responsible for all activity under your account unless the activity results from ACar's failure to use reasonable security measures required by law.

4. Electronic Communications and E-Signatures

You agree that ACar may provide notices and transactional communications electronically, including by email, in-app message, SMS or text message where permitted, push notification, account dashboard, or electronic-signature platform.

Certain legally required transaction records may require separate E-Sign Consent. If a transaction-specific E-Sign Consent applies, that consent controls electronic delivery, hardware/software requirements, withdrawal rights, paper-copy rights, and record-access procedures for those records.

5. Vehicle Listings, Pricing, Availability, and Seller Disclosures

Sellers must own the vehicle or have authority to sell it, provide accurate listing information, disclose known material defects, disclose title brands and liens, provide true odometer information, update material changes in condition or mileage, and comply with all federal and New Jersey motor vehicle laws. If a vehicle is titled to a business or other entity, the listing must be authorized by the entity and signed by a person with authority to bind it.

Vehicle listings may include seller-provided information, ACar-generated descriptions, third-party vehicle-history data, VIN decoding, pricing tools, inspection or scan information, photos, videos, and estimates. Listing information may be incomplete, delayed, or subject to correction. ACar may correct errors, require additional review, pause a listing, cancel a transaction before closing, or require updated documents if price, availability, title, odometer, lien, condition, tax, fee, or registration information is inaccurate or incomplete.

Vehicles are subject to prior sale, title review, payment review, seller performance, lien payoff review, identity verification, insurance verification, and completion of required transaction documents. Taxes, title fees, registration fees, lien payoff amounts, shipping/ transport, optional products, and government charges may be estimates until finalized.

ACar will provide a vehicle-specific FTC Buyers Guide for covered used vehicles. The Buyers Guide, bill of sale, warranty documents, as-is disclosure, odometer disclosure, and signed purchase documents control warranty status for a specific vehicle. General statements on the platform do not replace the vehicle-specific Buyers Guide or signed transaction documents.

6. Buying Vehicles

Buyers are responsible for reviewing all listing information, inspecting the vehicle, obtaining an independent inspection if desired, reviewing the Buyers Guide, and deciding whether to proceed before closing. ACar's administrative title, identity, scan, listing, or insurance review is not a mechanical inspection, safety inspection, insurance coverage opinion, or vehicle-condition warranty.

In ACar's New Jersey dealer sale process, the vehicle is sold by ACar NJ LLC as selling dealer, subject to the Buyers Guide, bill of sale, any written warranty, and non-waivable federal or New Jersey law. Where New Jersey used-car warranty law requires a written dealer warranty for a covered vehicle, that warranty applies as stated in the signed warranty documents and cannot be disclaimed except through a waiver that the statute itself permits. Any separate private-party support service is governed by the signed documents for that service.

7. Prices, Fees, Taxes, and Payments

Mandatory ACar service fees, if any, are disclosed in the applicable checkout or signed transaction agreement. Government taxes, title fees, registration fees, lien payoff amounts, optional services, and third-party charges may be itemized separately unless expressly included in a displayed all-in price.

Final checkout disclosures and signed transaction documents control the final transaction amounts, required fees, taxes, payment obligations, payout terms, refund terms, and release conditions for a specific transaction.

Buyer payments are processed electronically through Stripe and related banking infrastructure, typically by ACH bank transfer, and are received into ACar's payment-processing balance for the applicable sale. Funds may remain in that balance until disclosed release conditions are met. Seller proceeds are paid through a separate payout account and are released only after the payment shows as successful and available and ACar completes the required title, document, identity, insurance, pickup, and transaction-review steps. ACar may pay lienholders directly from transaction funds where a lien payoff applies. ACar is not a bank and does not promise that ACH settlement, bank posting, chargeback resolution, or seller payout will occur on a guaranteed date.

Do not send cash, wires, checks, or off-platform payments unless ACar gives written transaction-specific instructions. Off-platform payments can void ACar protections and may breach these Terms.

8. Title, Registration, Temporary Tags, and Insurance

For New Jersey transactions, ACar may prepare and submit title and registration paperwork to the New Jersey Motor Vehicle Commission, remit required taxes and fees, issue or request temporary registration tags when legally available, and coordinate permanent plates. Processing times depend on NJ MVC, lienholders, insurers, payment processors, sellers, buyers, and mail carriers.

ACar may rely on limited powers of attorney, title assignments, odometer disclosures, insurance documents, lien payoff authorizations, tax documents, and other records submitted by users or third parties. ACar may delay or refuse title, registration, payout, or closing activity if required documents are missing, inconsistent, expired, suspicious, or legally insufficient.

ACar's review of insurance is an administrative eligibility check for transaction and registration processing. It is not insurance advice, a coverage opinion, or a guarantee that a policy will cover any test drive, accident, loss, or claim.

9. Financing, Credit, and Financial Services

ACar is not a bank, lender, credit broker, or insurer, and ACar does not arrange, broker, negotiate, recommend, or submit applications for financing. You may independently arrange financing with a bank, credit union, or other lender of your choice. If you use outside financing, your lender's funds must be paid to ACar NJ LLC using ACar's written transaction-specific payment instructions, and ACar cannot complete closing, release the vehicle, issue temporary registration where available, or submit title/registration paperwork until the required funds are confirmed available and all transaction checks are complete.

Submitting information in any financing-related workflow does not guarantee approval, rates, terms, vehicle availability, or closing. The Financial Privacy Notice, any credit authorization, adverse action notice, risk-based pricing notice, or partner privacy notice controls the applicable financial information or credit process.

10. Messaging, Calls, and Notifications

ACar may send transactional communications about accounts, listings, appointments, verification, checkout, payments, title, registration, delivery, support, and documents. Marketing communications are subject to applicable consent and opt-out rules.

SMS and text messaging are governed by the SMS and Messaging Terms. Marketing text messages require consent and are not a condition of buying, selling, or using ACar services. You may revoke consent to text messages in any reasonable manner, including by replying STOP (or similar words such as QUIT, END, REVOKE, OPT-OUT, CANCEL, or UNSUBSCRIBE), and ACar will honor revocation within ten business days as required by FCC rules. Opting out of marketing messages does not stop transactional messages that are necessary to provide requested services, where permitted by law.

11. AI, Chat, Support Tools, and Automated Features

ACar may use automated tools, AI-assisted tools, chat features, vehicle-data tools, pricing tools, fraud/risk tools, or support tools where disclosed in the product or Privacy Policy. Outputs from these tools may be incomplete or inaccurate and should not be treated as legal, tax, insurance, credit, mechanical, safety, or investment advice.

You remain responsible for reviewing transaction documents, vehicle information, pricing, disclosures, and legal obligations before proceeding. ACar will not use AI output to override signed transaction documents, required disclosures, or non-waivable legal rights.

No AI assistant, chatbot, automated message, or support-tool output has authority to set or change a vehicle price, accept an offer, promise a discount, reserve or sell a vehicle, modify transaction terms, or otherwise bind ACar, a buyer, or a seller. The current vehicle listing, completed checkout records, and applicable signed transaction documents and disclosures control the transaction.

12. Acceptable Use and Prohibited Conduct

You may not submit false information, create fake listings, hide title brands or liens, manipulate odometers, evade fees, launder money, use stolen payment methods, harass users, compromise security, or conduct transactions outside ACar to avoid contractual obligations.

You may not crawl, scrape, harvest, index, mine, bulk download, aggregate, copy, store, republish, resell, or create datasets from ACar listings, vehicle data, photos, videos, descriptions, prices, VIN-decoded data, valuations, scores, user content, messages, or platform content without ACar's written permission. You may not use ACar content or data to train, test, fine-tune, evaluate, or enrich artificial-intelligence or machine-learning models without ACar's written permission.

You may not circumvent rate limits, robots.txt, authentication, paywalls, access controls, API restrictions, security controls, or technical measures. You may not re-identify, enrich, or combine ACar data with other datasets in a way that violates law, privacy rights, or these Terms.

We may suspend accounts, remove content, cancel transactions, refuse services, withhold payouts while investigating fraud or title defects, report suspected unlawful conduct, or require additional verification when reasonably necessary.

13. User Content and Intellectual Property

You retain ownership of content you submit, but you grant ACar a non-exclusive, worldwide, royalty-free license to host, display, reproduce, modify for formatting, distribute, and use that content to operate, market, support, secure, and improve the platform, related listings, and related transactions.

Operational use may include listing display, listing syndication, buyer/seller communications, fraud review, document preparation, customer support, analytics, image processing, and transaction records. ACar will seek additional consent before using your name, likeness, testimonial, or personal story in broad brand marketing unrelated to the listing or transaction, where required by law.

You may not use ACar trademarks, software, listing data, images, or other protected content except as permitted by ACar in writing or by applicable law.

14. Reviews, Ratings, and Feedback

If ACar allows reviews, ratings, testimonials, or feedback, you must provide truthful content based on your actual experience. You may not submit fake reviews, compensated reviews without disclosure, reviews on behalf of another person, reviews about competitors for improper purposes, or content that manipulates ratings or misrepresents a transaction.

ACar may moderate, remove, or restrict reviews and feedback to prevent fraud, abuse, privacy violations, illegal content, or misleading statements.

15. Disclaimers and Liability Limits

The platform is provided as available. ACar does not guarantee uninterrupted access, error-free operation, buyer availability, seller availability, listing performance, a specific sale price, vehicle availability, a specific MVC processing timeline, or a specific payout date.

To the maximum extent permitted by law, ACar is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages. ACar's aggregate liability for a claim is limited to the greater of $100 or the ACar fees you paid for the transaction giving rise to the claim.

This limit does not apply to fraud, willful misconduct, gross negligence, personal injury caused by ACar negligence, or non-waivable statutory rights, including rights under the New Jersey Consumer Fraud Act, New Jersey used-car warranty laws, federal odometer law, privacy laws, or other rights that cannot legally be waived or limited.

16. Disputes, Arbitration, and Small Claims

Disputes with ACar are governed by the standalone Arbitration Agreement if you accepted it and did not timely opt out. That agreement explains that you may be waiving the right to sue in court, have a jury trial, or participate in a class action. Small-claims court remains available where permitted by that agreement and applicable law.

Any contractual claim under these Terms must be brought within one year unless applicable law prohibits shortening the limitations period. This does not limit non-waivable statutory consumer-protection rights.

17. Changes, Termination, and Notices

We may update these Terms prospectively. Material changes will be posted on the platform and, where appropriate, emailed or shown in-product. The version you accepted for a signed transaction continues to govern that transaction unless you accept a later transaction-specific amendment.

Notices to ACar must be sent to ACar Technologies, Inc., Attn: Legal Department, 330 E. Commerce St., Ste #186, Bridgeton, NJ 08302, or by email to [email protected]. These Terms are governed by New Jersey law, without regard to conflict-of-law rules.
