Financial Privacy Notice

ACar's role: ACar Technologies, Inc. operates the platform. Certain dealer, title, registration, tax, temporary-registration, and related motor-vehicle services are performed by or through ACar NJ LLC, a licensed New Jersey used motor vehicle dealer. ACar's exact role in any vehicle transaction depends on the signed transaction documents for that vehicle.

1. Scope

This Financial Privacy Notice applies to financial information ACar collects or receives in connection with payments, payouts, refunds, lien payoff, tax and fee collection, bank verification, seller payout setup, and any financing, credit, or financial-service workflow made available through ACar or an ACar partner.

ACar is not a bank, lender, credit bureau, insurer, or broker unless a separate signed document expressly says otherwise, and ACar does not arrange or broker financing. If a lender, payment processor, bank, or other financial partner provides a product or service, that partner's terms and privacy notices may also apply.

2. Financial Information We Collect

  • Payment method details, payment tokens, bank-account verification records, Stripe identifiers, and transaction status.
  • Seller payout account setup information, connected-account identifiers, payout status, and tax records.
  • Purchase price, deposits, fees, taxes, registration/title amounts, refunds, chargebacks, failed payments, and accounting records.
  • Lienholder names, payoff amounts, payoff quotes, account-reference information, funding instructions, and lien-release records.
  • Credit application, consumer-report authorization, lender-offer, or financing information only if you submit it in a workflow where that service is offered.
  • Fraud, sanctions, risk, identity, insurance, device, and transaction-review signals used to protect financial workflows.

3. How We Use Financial Information

  • Process payments, payouts, refunds, chargebacks, taxes, government fees, lien payoffs, and seller proceeds.
  • Verify identity, account ownership, transaction eligibility, payment status, fraud risk, and sanctions-screening status.
  • Prepare and maintain transaction records, accounting records, title/registration records, tax records, and dispute files.
  • Coordinate with payment processors, banks, payout providers, lienholders, lenders, tax providers, and government agencies.
  • Provide financing or credit-related services only if those services are made available and you choose to use them.
  • Comply with law, enforce agreements, prevent fraud, resolve disputes, and respond to lawful requests.

4. How We Share Financial Information

We may share financial information with:

  • Stripe, banks, payment processors, payout providers, card networks, ACH processors, and fraud-prevention providers.
  • Lienholders, lenders, financing partners, insurance providers, tax providers, title/registration providers, and NJ MVC where needed for a transaction.
  • Buyers, sellers, or transaction participants when the information is needed to document, fund, close, cancel, refund, or dispute a transaction.
  • Professional advisors, auditors, insurers, regulators, courts, law enforcement, and government agencies where required or appropriate.

We do not sell financial information for money. We do not use financial account information, credit-report information, or lien payoff information for targeted advertising.

5. Credit and Financing Workflows

ACar does not arrange or broker financing. Buyers using outside financing are responsible for arranging approval with their own bank, credit union, or lender, and the lender's funds must be paid to ACar NJ LLC using ACar's written transaction-specific payment instructions before closing. ACar records the lender, funding amount, and funding status in the transaction file.

If ACar later offers or enables credit applications, prequalification, lender offers, or consumer-report workflows, additional authorizations, lender notices, credit notices, adverse-action or risk-based-pricing notices, and partner privacy notices may apply. Those notices will control the applicable credit or financing process to the extent they conflict with this Notice.

6. Retention and Security

We retain financial information for as long as needed for payments, payouts, accounting, tax, title, registration, lien payoff, fraud prevention, chargebacks, disputes, legal compliance, audit, and enforcement. Some financial and transaction records cannot be deleted while retention is legally or operationally required.

We use administrative, technical, and physical safeguards designed to protect financial information, including vendor controls and access limits. No system is perfectly secure.

7. Your Choices and Contact

You may choose not to submit optional financial information, but ACar may be unable to process a payment, payout, lien payoff, refund, title/registration filing, or related transaction service without required information.
