1. Service Description
ACar's Private Sale Service helps buyers and sellers who have already agreed to a vehicle transaction complete identity verification, documents, title transfer, NJ MVC registration, temporary-registration processing where legally available, payment processing if selected, and related support. The vehicle sale remains between the private buyer and private seller unless a signed transaction document expressly states a different structure for that deal.
2. Scope of Service
- Full Service: title and registration support, document generation, identity checks, payment processing through Stripe, release coordination, temporary-registration support, and plates/registration tracking.
Full Service is the service ACar currently offers for private-party transactions. The current service fee, and who pays it (buyer, seller, or split), are shown before you start and at checkout.
3. Electronic Signing
Transaction documents are signed electronically under the E-Sign Consent. If you have already accepted the E-Sign Consent on your ACar account, it applies to your private-sale documents and you will not be asked to accept it again unless it changes or you withdraw consent.
4. Fees, Taxes, and Government Charges
Current ACar service fees, government taxes, title fees, registration fees, lien payoff amounts, and third-party charges are shown at checkout or in the signed transaction packet. Government and third-party fees already remitted are generally not refundable by ACar.
5. Buyer Obligations
- Provide accurate legal name, address, driver's license, insurance, and payment information.
- Complete identity verification and sign required transaction documents.
- Inspect the vehicle before closing and decide whether to proceed.
- Maintain legally sufficient insurance and confirm coverage with the insurer.
- Use temporary registration only as permitted by law and the issued tag record.
6. Seller Obligations
- Own the vehicle or have legal authority to sell it. Entity-titled vehicles require proof of authority and an authorized signer.
- Disclose known material defects, title brands, odometer discrepancies, liens, and payoff requirements.
- Provide the original title and all documents required for transfer.
- Complete identity verification and sign required sale, odometer, title, lien, and payout documents.
- Cooperate with lien payoff and title release if the vehicle is financed.
7. Payment Processing and Release
In Full Service transactions, buyer funds are processed through Stripe and may be held in ACar's Stripe platform balance pending manual release. Release to the seller occurs only after the disclosed release conditions are satisfied, such as identity verification, document completion, pickup or delivery confirmation, lien/title review, and any required ACar approval. ACar does not guarantee ACH settlement, bank posting, chargeback resolution, or payout by a specific date.
8. Insurance Review
ACar's review of insurance is an administrative eligibility check for transaction and registration processing. It is not insurance advice, a coverage opinion, or a guarantee that a policy will cover any test drive, accident, loss, or claim. Buyer and driver remain responsible for confirming coverage with their insurer.
9. Registration Timeline and Temporary Tags
ACar submits title and registration paperwork to NJ MVC after it receives the required signed documents, payment information, insurance, identity verification, title information, and any lien release materials. Temporary tags and extensions are issued only when legally available and operationally approved. NJ MVC, lienholders, insurers, payment processors, and mail carriers may delay processing.
10. Cancellation and Refunds
You may cancel before vehicle handover and before ACar has submitted government paperwork or released seller funds. After title or registration paperwork is submitted to NJ MVC, the transaction generally cannot be cancelled through ACar, subject to non-waivable law. Approved refunds are initiated to the original payment method within the timeframe shown in your service flow; bank or card posting may take longer. ACar may deduct service costs that were disclosed before you paid, and cannot refund taxes, government fees, or third-party fees already remitted.
11. Limits
ACar does not inspect or warrant the vehicle, provide insurance advice, provide legal advice to either party, guarantee NJ MVC timing, or resolve private buyer-seller vehicle-condition disputes except as expressly stated in a signed transaction document.
