Appointment & Test Drive Terms

These Appointment & Test Drive Terms apply when you schedule, request, confirm, attend, host, or participate in an in-person appointment, vehicle viewing, test drive, at-home test drive, pickup meeting, or related meeting arranged through ACar. They supplement ACar's Terms of Service, Privacy Policy, Disclaimers, and any transaction-specific agreement you sign.

ACar Technologies, Inc. operates the platform and ACar NJ LLC may provide licensed dealer, title, registration, and transaction-support services. For appointment scheduling, ACar coordinates communications, scheduling tools, reminders, and administrative verification steps. ACar does not supervise the in-person meeting, control either party's conduct, select the driving route, control road conditions, provide security, or provide insurance coverage for the appointment or test drive.

The in-person appointment and any test drive are between the buyer, primary driver, seller/current vehicle holder, and any listed guests. Each participant is responsible for deciding whether the meeting location, vehicle condition, driver, weather, traffic, and surrounding circumstances are acceptable before starting or continuing the meeting. Either the seller/current vehicle holder or the buyer/driver may decline, stop, or end the appointment at any time if they are uncomfortable.

• Participants must follow the confirmed appointment type and location, including any inspection-only, buyer test-drive, seller ride-along, or at-home setting.
• The seller/current vehicle holder must make the vehicle reasonably accessible for the confirmed activity and must not knowingly permit it to be driven when it is unsafe to operate.
• If driving is permitted, the vehicle holder must maintain legally required registration and insurance for the vehicle, and the verified driver must satisfy the separate driver requirements below.
• Either participant may pause or end the appointment for a reasonable safety, verification, vehicle-condition, weather, traffic, or location concern.

• Only the verified primary driver may operate the vehicle during a test drive.
• The driver must hold a valid driver's license for the vehicle being operated.
• The driver must carry legally required proof of insurance and must confirm coverage with the driver's insurer before the test drive.
• Insurance verification through ACar is an administrative eligibility check only. It is not insurance advice, a coverage opinion, or a guarantee that any insurer will cover a test drive, accident, loss, claim, injury, theft, citation, or vehicle damage.
• No participant may allow an unverified, unlicensed, uninsured, impaired, or unauthorized person to drive.

• Follow all traffic laws, speed limits, parking rules, and instructions from law enforcement.
• Do not race, tow, off-road, overload, abuse, or intentionally stress the vehicle.
• Do not drive while impaired, distracted, fatigued, or medically unsafe to drive.
• Stay on the agreed route and return the vehicle promptly to the agreed location.
• Do not smoke, vape, consume alcohol, use drugs, carry unlawful weapons, or bring pets into the vehicle unless the seller/current vehicle holder expressly agrees.

To the fullest extent permitted by law, the buyer, primary driver, seller/current vehicle holder, and guests are responsible for their own conduct during the appointment. ACar is not responsible for accidents, citations, tolls, towing, impound fees, injury, death, property damage, vehicle damage, theft, lost property, personal disputes, or third-party claims arising from the in-person appointment or test drive, except to the extent caused by ACar's own negligence where applicable to personal injury or death, gross negligence, willful misconduct, fraud, or non-waivable statutory responsibility.

The seller/current vehicle holder may refuse or end a test drive if the driver has not completed required verification, does not have a valid license, cannot provide acceptable proof of insurance, appears impaired or unsafe, brings unlisted guests, refuses reasonable route limits, or otherwise creates a safety or property risk.

ACar may record your acceptance of these terms with your user ID, appointment ID, version, timestamp, IP address, device information, and related audit data. If you do not agree to these terms, do not schedule, confirm, attend, host, or participate in an appointment or test drive through ACar.
